Prop 8 Goes Down

In a landmark decision, Prop 8 was ruled unconstitutional under the 14th Amedment. Basically, after determining that federal law applied, given that marriage is a fundamental right, the trial judge determined that Prop 8 denied gays due process and equal protection. The case sets up appeal to the 9th Circuit, which sets up appeal to the Supreme Court. Welcome Justice Kagan.

Unlike other cases, which are based on State law, this case involved the federal constitution. That’s the document that safeguards us all.

Interestingly, the right wing nut jobs have tried to characterize this as a a ruling against the will of the people. Nothing could be further from the truth. The will of the people is that a super majority is required to overrule the Constitution. Supporters of Prop 8 have no where near that.
